Non-Durable Power of Attorney
A Non-Durable Power of Attorney will not be enforceable if the person who has signed it becomes incapacitated or incompetent (i.e. in a Comma). This could be a condition that a person would prefer. If the Power of Attorney doesn’t say that it is “Durable” then it is considered to be “Non-Durable.”
